I am the Interstate Compact contact person for our county. For the uninitiated, the Interstate Compact is a set of rules and procedures that all probation and parole departments from all states must comply with when transferring supervision of probation from one state to another.
Well, all states are SUPPOSED to comply with the rules and procedures.
The basic set-up for an interstate transfer is this: each state has its own Interstate Compact office. A transfer request goes from the local probation officer to the Interstate Compact office of his/her own state, to the Interstate Compact office of the receiving state, to the local probation officer in the receiving state. Communication from the receiving state takes the reverse path back to the original probation officer. So, for instance, if I want to transfer supervision of probation to Pullman, Washington, my request first goes to the Indiana Interstate Compact Office in Indianapolis, then to the Washington Interstate Compact Office in Olympia, then to the local probation department in Whitman County, Washington.
The whole process is done electronically. There are a whole slew of rules that we have to follow (somewhere around 65 pages, if I remember correctly), full of criteria that make transfers mandatory (the receiving state is required to accept supervision) or discretionary (the receiving state has the option to say, "No, thanks. Keep your probationer in your own state.") and full of deadlines for various procedures. Transferring probation to another state is a rather time-sensitive process. The ladies who work in the Indiana Interstate Compact Office have done a great job emphasizing to all of us that we are subject to massive fines, the wrath of God, and other bad things if we don't comply with the rules and the time deadlines. So I work hard to make sure I'm always in compliance.
That apparently doesn't hold true for other states, however. I am CONSTANTLY frustrated by other states that clearly have no regard for the Interstate Compact rules.
Most recently, I sent a transfer request to California. By rule, they have 45 calendar days to investigate the request and respond. Forty-five days came and went, so I sent a message to California, asking them to respond. No answer. I enlisted the help of the Indiana Interstate Compact Office, who contacted the California Interstate Compact Office, who contacted the local probation officer in California. No answer. More messages went to California, asking them to respond to the transfer request. No answer. Finally, after 104 days--more than twice as long as the Interstate Compact rules allow for--California responded...and rejected my request. After the rejection, I sent a message out there, asking if there was a particular reason that it took 104 days to respond, when the rules only allow for 45 days. You can probably guess how that has worked out. No answer.
Right on the heels of that fiasco, I sent a request for reporting instructions to Georgia. Reporting instructions are who, when, and where the receiving state wants the probationer to report to upon arrival in the receiving state. By rule, states have two (2) business days to respond to a request for reporting instructions. I sent my request on July 29, which gave Georgia until August 2 to respond. August 2 comes and goes, and no response. The Indiana Interstate Compact Office was all over it, and they immediately started sending messages to the Georgia Interstate Compact Office, requesting a response. It took somewhere in the neighborhood of five or six messages for Georgia to finally respond--on August 11. That's nine (9) business days, for those of you scoring at home. Their reasoning for being so slow? They're down three employees right now, so they're really busy. I didn't realize that being busy exempted us from complying with the Interstate Compact rules!
Speaking of Georgia, I transferred someone to them quite some time ago, and when it came time to discharge his probation, I ran his criminal history...only to discover that he had committed a new criminal offense in Georgia that they never told me about. Not only had he been arrested, he had been convicted, placed on probation in the same county that was supervising my case, violated his probation there, and was sent to jail on their case. But for some reason, Georgia never stopped to think that I might want to know about that, too.
And STILL speaking of Georgia, I currently have a probationer I transferred there over a year ago. Interstate Compact rules require that we send annual progress reports to the sending state when supervising one of their probationers. Has Georgia done that? No. But they want to close her case out (two months past her discharge date) because her probation has expired. I sent a message to Georgia, telling them that I won't approve the case closure until they send me a progress report, since I have no idea what she has completed and not completed while on probation. In fact, I had to file a probation violation, alleging that she completed nothing while on probation, because I had no information from Georgia to the contrary. I sent the message to Georgia a week and a half ago. Still waiting on that progress report.
Florida routinely pisses me off. The latest was a probationer of theirs who I was supervising, and he picked up new felony charges here in Indiana. Florida issued a warrant for his arrest as a result, didn't bother to notify me that the warrant was issued for over a month, and then when my probationer was arrested on the warrant, Florida refused to extradite him. So Indiana authorities had to release him. I sent repeated messages to Florida asking them what, exactly, they wanted me to do with him since he's doing nothing on probation, he's not paying any of his fees owed to Indiana, he's committing new felonies here, he has a warrant out of Florida, but Florida won't come and get him. Weeks go by with no response. So I ask them to allow me to close out the case. A month and a half goes by, and no response. The Indiana Interstate Compact Office got involved, and after lots of messages back and forth, Florida finally responded: they denied my request. They still want him to report to me. Why? I have no idea. Absolutely nothing constructive is coming from me wasting my time meeting with him.
Texas has pissed me off several times. So has Kentucky. And New York. Arkansas ignored me when I was having problems with one of their probationers and was asking for their help. My one experience with Utah has been a pain in the ass, trying to get any response of any kind from the Utah probation officer. Ohio is hit or miss--sometimes they're great, and sometimes they're total pricks. I'm not entirely convinced that Virginia has computers, because I routinely send stuff there, never to be heard from again.
Illinois has pissed me off a few times by rejecting various requests before they even send it to the local probation officer to decide. One time, I sent a discretionary transfer through, but it was going to the county where one of my favorite probation officers in the whole wide world works. I was pretty confident that she'd accept supervision, even though she didn't have to, because she understands the concept of doing what's best for the probationer, even if it means more work for her. But the Illinois Interstate Compact Office didn't even let her see the request, much less respond to it. They just denied it. So I contacted her directly, we worked out a little arrangement on the side, and she supervised my probationer for me outside of the rules of the Interstate Compact.
I could go on forever with war stories from the Interstate Compact. I'm not saying that Indiana's poop doesn't stink, but by God, if you transfer a case to my county, you're not going to have any of the above problems.
What sets me off the fastest is when states don't give a damn about what's best for the probationer. All they do is look for a reason not to accept the case, so they don't have to do the additional work.
It also sets me off when probation officers in other states don't respond to requests for communication. We're on the same team, folks! Show a little professional courtesy! Treat others the way you want to be treated!
And it chaps my hide that these offending states never suffer any consequences. No fines, no wrath of God, no sanctions for thumbing their noses at the Compact rules. So what motivation do they have to change their ways? None.
I have had some good experiences with the Interstate Compact. Oklahoma accepted a case from me that they weren't required to. So did Hawaii. I've had mostly good experiences with Michigan. South Dakota is doing a great job with one of my current probationers. West Virginia has communicated well with me on a few cases, and South Carolina has been more good than bad. Arizona was a total pain in the ass before the current automated system went into effect, but now they're pretty good.
And just today, with the help of one of the ladies at the Indiana Interstate Compact Office, Tennessee did me a huge favor and let one of my probationers head their way immediately, when they didn't have to.
So I'm curious. If anyone is still awake after reading this novel, and you have experience with the Interstate Compact, as a state contact person, a local probation officer, or a probationer, post a comment below and share your experiences, good or bad. I'm curious to know if I'm the only person in the country who wants to drive down to Atlanta and smack every one of those people in the Georgia Interstate Compact Office up side of the head, and if my positive experience with Tennessee was an anomaly, or if that's how they normally do business.

Virginia is REALLY bad!!! I was supervising on of their people. Who was originally sent to Marion Co. The Marion Co. PO sent 2 violation reports and the case was not retaken. The client moves for the 5th time in a year to My County. I submitted 7, count them, 7 Violation reports over a 4 month period for things such as Meth positive screens (5 to be exact), not doing Tx, commiting a new offense, and failing to report to appts. (He just didn't show up 3 weeks in a row.) They just kept sending responses that acknowledged receiving the report, no action. Then 3 months in they said they would request a warrant, which I had been requesting since day one b/c my first violation report was technically his 3rd violation. Finally after another 3 months they finally get the warrant. As soon as they had the hold at the jail, I sent my case closure notice and basically said, you better approve this! That was fun!!!

My husband and I are having a baby in August and we have no where to go,his probation officer won't even put in paper work for the compact or return our calls. Somehow this just doesn't seem legal to me! We are trying to get to Florida where my family is so we can have a safe and clean environment for a new born,people in this system seem so heartless and lazy to me. I've decided if no one can help us I'm having the baby in California and then going to Florida by myself...it's so sad that laziness can split up families. I can only pray and hope someone can help us! If you have any advice it would mean so much to us,as we can't afford any legal help.

ReplyDeleteWithout knowing anything about your husband's case, it's impossible to determine whether or not Florida would be required to accept supervision. If Florida is NOT required to accept supervision, I can virtually guarantee you that they won't accept it.
It may be that your husband's PO knows this and isn't going to waste his/her time, or it may just be that the PO is lazy. The absolute worst state that I've had to deal with is California. A close second is Florida.
You can always take your concerns to the PO's supervisor. As a supervisor, I would want to know if one of our officers is not doing his/her job.
Ultimately, it's completely within the sending state's discretion whether or not to allow someone to move. A person on probation has no constitutional or statutory right to move to another state.

ReplyDeleteThis process is a nightmare...you feel so lost while it's going on and there is no one to turn to. It's seems like each state want's to shrug the responsibility and put blame on each other.
What amazes me is that Interstate Compact designed a new computer system for this process to go smoother...yet because most probation officers are afraid of the "google" and the world wide web they don't even want to deal with it.
And Interstate Compact doesn't want to get it's hands involved in the states issues yet that is exactly what their role is defined as.

I'm glad to know that someone actually cares about the interstate compact, that people deserve a chance, and not accept something because of some more work. My husband is the perfect example. He had a bad past, got out of prison in July, and now has about two more years of parole come July. Well I am from Colorado, and I have a baby that is due in August. Well we sent the compact(to CO) in February because his PO here sees that he is doing extremely well, and has not been in trouble since being out. Well we went in Monday, and the paperwork is in the field office, and then today we hear it got denied, but they asked for more paperwork, like his current supervision terms, and his visitations. All of this was in the paperwork, but they just refused to look at it, and sent it right back. His PO says there is hope, and dont give up on it, and he is forwarding everything back tomorrow to the field office. So hopefully they actually look at it, and not just shun it away, because seriously there are no opportunities here, and I want to go back home, but I dont want to be without my husband.
ReplyDeleteMy domestic partner is currently on probation in Oregon and I recently accepted a job in California. He has no other family or means of support, and has been staying with a friend there who will be moving out of state in 2 months. At that time, he will be utterly homeless and without any means to support himself. His PO just says "get a job," which as we all know is a lot easier said than done - not only in the current job market in general, but having felonies makes it nearly impossible.
ReplyDeleteCalifornia says I have not had permanent residence here long enough to allow my partner to stay with me (I need another 5 months residence, according to them). But we have looked into it and asked about the discretionary transfer clause. When I called the CA ICAOS office to ask about it, they basically told me to f$%k off and not bother them. Housing assistance is non-existent there too.
What can we do in this situation? We don't want him to violate probation by leaving the state, but him being homeless during the winter seems totally inhumane!
My husband is currently in GA and we have been trying for months to get his instate compact processed. He initially completed this paperwork in May, it was never sent over. He was asked to sign and complete forms for his interstate compact on Nov. 1st, as he's set to be released Dec. 19th. That was done, but trying to track the package down and see where it is, is a nightmare. He does not live in GA. We resided within the state of CA. He has no family ties there but they said that if his paperwork has not been completed he will have to stay in the state of GA at least 45 days. Who has money for that? We don't! Everyone that I call is NOT helpful at all. No one returns messages, no one talks to you. When I called the intertate compact office and told them that I was his wife and that I just wanted to know if his instate compact package was received and if it was being processed. I was told that my question could not be answered for security reasons... But I didn't ask a security compromising question. My husband is a person not just a GDC#. He needs to be able to make it home. Would a prison release an inmate knowing that they have no where to go? Especially if their home is another state? If you reside in a different state, is the interstate compacts approval or non-approval part of the processing of a prisoners release?

DeleteWell... the Indiana Compact Office really isn't so great... my husband was extradited from Tennessee to Indiana 2 years ago because of an 11 year old violation of probation when he was 20 years old. He served 18 months and was paroled via Interstate Compact to Tennessee. After 4 months of parole he committed a misdemeanor offense in Tennessee. Before being convicted in Tennessee, Indiana sent an all state warrant, but said they couldn't pick him up from Tennessee until his sentence there was served. And they sent another notification they had to lift the warrant if the sentence ran longer than his parole end date. But.. Indiana just loves wasting taxpayer's money and is extraditing him AGAIN because of parole violation to serve a puny 7 months. Indiana won't see a dime from us, but the taxpayers there are gonna foot that bill too... lmao.. pretty stupid state if you ask me. And you think your perfect cause you answer stuff from other states...? I seriously doubt it.. and Ronald Leffler is the biggest dumbass of all sending out confidential ICAOS paperwork out to people. If it were up to me, you wouldn't have to bitch about your job cause I would have your stupid state removed from the Interstate Compact Commission faster than you can bitch about it...
ReplyDeleteI am going through what feels like a nightmare right now I was approved my California my sending state in August and the receiving state Utah waited till the 42nd day to even do the home check at my adult Childs home...they have a room in their home for me they had no alcohol in the home which I guess is a requirement and here we are on the 55th day and nothing yet..i have spoken to the Utah case worker at the ISC office more than once and even sent her a heartfelt email..but she doesn't seem to care. From what I see I am a mandatory transfer..do they still look for a reason to deny with a mandatory transfer? I am in limbo trusting in God but frustrated I've missed another Halloween with my toddler grandchildren and here we are 2 weeks before thanksgiving...im feeling very discouraged and bummed out..any thoughts or opinions would be appreciated..thank you......Jamie aka: gaga(grandma) lol

My kids father, who I plan on marrying Nov 28th, 2014, is trying to transfer from Pennsylvania to Georgia. PA has been great and moved the paperwork quickly, once it hit GA its been a joke ever since. The 45 day deadline is in 3 days and they still have not even conducted a home check. The local PO office received his paperwork on September 22nd, and only after I contacted them did I know who his case had been assigned to, I went to the office and turned in birth certificates and signed papers back on October 2nd. and havent heard another word since. Texts, calls and emails to PO have been ignored. Interstate Compact Georgia advised me the PO's deadline was teh 16th to return her decision. Today is the 20th, and still nothing, and no home check or responses to text or emails from this morning. I'm sure it will be safe to say that the 45 day deadline will not be met. I guess since this does not affect any of their families they really don't give a damn. There are a lot of people still out of work, how about giving them a job - they would probably do a much better job of it and be grateful to have a job instead of treating it like a burden. I am just disgusted with the whole process. I bet if my fiance' was to violate his parole they would not take this much time to process a conviction!!
ReplyDeleteHi I'm currently waiting . For PA to transfer me to NC , it'll be 3 months Tuesday July 14th since I filled out paperwork with my po. She just says I have to wait. So frustrating, I have family there in NC and I've lived there before, so I assume it's mandatory. I am hoping you can tell me who you contracted in GA to figure out when they received the sending states paperwork. I'd really like to try to get a better answer than "wait" if I could . How long did the whole thing wind up taking for your husband?
DeleteFather of my baby to be born in Febuary is trying to transfer from minnisota to Alaska, it's been 40 days and haven't heard a single word from Alaska or his Probation Officer. What happens after the 45 days? Do we still wait for a yes or no? It doesn't help that our PO never returns our phone calls and doesn't keep us updated on anything. I have personally gone in to the Alaska probation office and they just keep saying that it is "pending"
ReplyDeletemy husband paroled in ca... while i had moved to nv.. it took 3 months for his transfer. he had got in trouble in nv... and got arrested in nv. they put him on "parole" instead of probation. he got in trouble AGAIN... so they told him he had to move back to his sending state! so WE moved back to CA.... he finished his parole for CA. so now CA is babysitting for NV. my husband had been arrested and found not guilty. he just had a parole violation and has been in co. jail for 4 months. he has not been released yet.. and had a court hearing stating nv had issued a warrant because he was instructed to report back to NV 3days before he was arrested... a INTERSTATE COMPACT HOLD is what the judge had told him.. and NV has 10 days to come get him! its been 12 days... he still is in jail! deputys there said its 14days!?!? no one is sure??? ca probation officer said they wrote NV about his incareration.... DeleteMy husband was told by his PO in NY that he sent the transfer request to FL 4 weeks ago where myself and our sick infant resides. I called NY headquarters in Albany today and was advised they have never received the request to transfer at all. Meanwhile his PO has refused to follow up with Albany, and told him today the reason why they said that is because theres a paper he has to sign, but he just saw him yesterday and he never mentioned it, he sees him every week. Meanwhile I am in FL without him, supporting our children on my own with a sick infant whom I have to miss work for because I am an only parent. Someone please help. I need advice, Ive already contacted a lawyer. Is this even legal?

My transfer from Idaho to NYC went through within the 45 day time frame. But I began the process before my release from prison. I was out 5 days and on a plane to New York after a quick pickup of papers permitting me to travel (which nobody ever asked to see). I have about 6 months left on my sentence. New York probation officers shake their heads or laugh at me, saying that if the situation had happened in New York I wouldn't even have a misdemeanor, let alone 2 felonies. I am a joke to them. "We don't send people to prison for felony possession when they overdose. It's just not done here..." etc. etc. In Idaho I went straight to jail, then to prison after 10 days in the hospital. Idaho hands out felonies like TD bank hands out free pens and lollipops. Leaving that state is what made me successful. Idaho severely marginalizes felons, making it extremely difficult to get a job, even HOUSING! Here in NYC, it's illegal for an employer to ask about criminal convictions unless it's a financial institution or other federally regulated industry. Thus, I have a great job, a nice apartment in the Upper East Side, and a totally normal life. Why? Because I am allowed to lead a normal life. It's that simple. Keep treating people like criminals and they tend to stay criminals. Get your shit together IDAHO! The wonderful life, marriage and career I have now would have been impossible if I had stayed in that fascist state. I'm sorry I ever moved there in the first place.

He apologized but no one in his office or tallahassee caught onto it until Pa got it. He resubmitted it today. I will be homeless in 2 days. How can i get emergency reporting instructions
